The Supreme court directed the Himachal High court to hear the recall application of Director general of Police Sanjay Kundu against the impugned order of December 26 and dispose off the matter within 2 weeks. The apex court also stayed the transfer order of DGP Sanjay Kundu. The matter was heard on Wednesday morning in a three-judge bench headed by Chief Justice D Y Chandrachud, Justice Manoj Misra and Justice J B Pardiwala.

  • The bench in an open court while dictating the order stated that liberty is granted to the petitioner to move the high court with an application to recall the order announced on December 26, 2023, within two weeks. The court further added, ” Till the recall application is disposed of, the directions for the transfer of the petitioner out of the post of Director general of Police, Himachal Pradesh shall remain stay. Adding, “The court has been uprised with the fact that on January 2, 2023, the petitioner in compliance with orders of the High court been posted as Principal Secretary (Ayush) Government of Himachal Pradesh. Since the above action is in pursuance of the interim order of the High court, we also direct that pending for disposal of recall application, no steps shall be taken to enforce the order dated January 2, 2024.

The apex court in the order further noted that, the protection which has been granted by this order to the petitioner is in view, that he was not heard by the High court when the interim order was passed on December 26, 2023.
