To protect the interest of the requisitioning authority and to maintain the sanctity of the recruitment process for safeguarding the interest of all participating candidates, the High Court of Himachal Pradesh today issued following directions to the H.P. Staff Selection Commission, Hamirpur:
On receipt of objections against the provisional
answer key within stipulated time period, the HPSSC shall
display serial numbers of disputed questions, disputed
answer etc. and gist of the objections received by it on its website.
All such candidates/participants who are desirous to furnish their comments/response to the objections so received by the HPSSC as displayed on it’s website will be permitted to do so, within a stipulated time frame, to be fixed by the Commission.
The HPSSC in accordance with applicable rules, guidelines & instructions and also taking note of the objections & comments/response thereto received by it shall decide within a fixed time schedule, the objections received by and display it on its website.
The HPSSC upon deliberations and decision so arrived at shall publish the revised/final answer key.
A Division Bench comprising the Chief Justice A.A. Sayed and Justice Jyotsna Rewal Dua, passed this order on an appeal filed by H.P. Staff Selection Commission, Hamirpur against order dated 30.10.2020, passed by the Single Bench, on a petition filed by one Anshul Guleria. The Single Bench directed the HPSSC to ensure that in future, in any selection process undertaken by it, if such an eventuality does arise where candidates who earlier might have had not submitted their objections to the provisional answer keys, but who are to be affected by changes to be made in the answers on the basis of objections filed by other candidates, are given an opportunity of putting forth their stand before the final answer key are published and acted upon.
Aggrieved against the aforesaid judgment of Single Judge, the HPSSC has preferred the instant Appeal. The Double Bench modified the impugned judgment to the extent indicated above and also waived off the costs imposed upon the appellant HPSSC.
