The High Court of Himachal Pradesh, has directed the State Government to grant the pay scale of the post of Trained Graduate Teachers (TGTs) and also the promotional avenue to the post of Lecturer (School Cadre), to the Trained Graduate Teacher (TGT)-Sanskrit and TGT-Hindi, respectively.

     The High Court of Himachal Pradesh, has directed the State Government to grant the pay scale of the post of Trained Graduate Teachers (TGTs) and also the promotional avenue to the post of Lecturer (School Cadre), to the Trained Graduate Teacher (TGT)-Sanskrit and TGT-Hindi, respectively.

Justice Jyotsna Rewal Dua, passed this order on a number of petitions involving common questions of law and facts.

The case of the petitioners is that they were serving as Language Teachers (LT) and Shastris.  All the petitioners are B.Ed. qualified and have also passed Teachers Eligibility Test. On 20.08.2022, the respondents-State issued a notification, changing the nomenclature of B.Ed. qualified and Teachers Eligibility Test (TET) passed Shastris (Sanskrit) and Language Teachers (Hindi), as Trained Graduate Teacher (TGT)-Sanskrit and TGT-Hindi, respectively.

The claim of the petitioners is that despite the change of nomenclature of the posts, they have not been granted pay scale of the post of Trained Graduate Teachers (TGTs) and also the promotional avenue to the post of Lecturer (School Cadre). The petitioners contended that not only the pay scale attached to the posts of TGTs is required to be given to them, but the same channel of promotions as is available to the TGTs is also required to be made available to them.

After hearing the counsels for the parties at a length, the court found that the duties performed by TGTs (Sanskrit & Hindi), are akin to ones discharged by TGTs (Medical, Non-Medical & Arts). But the TGTs belonging to Medical, Non-Medical and Arts streams enjoy higher pay scale.

Allowing the petitions, the Court has directed the respondents to grant the pay scale of the post of Trained Graduate Teachers (TGTs) and promotional avenue to the post of Lecturer (School Cadre), to the petitioners who have been re-designated as TGT (Sanskrit) & TGT (Hindi), respectively, as is being given to TGT (Medical, Non-Medical & Arts), from the date of issuance of notification dated 20.08.2022, within seven weeks.
